Welcome to Aquaholic Gifts Pte Ltd (“Aquaholic Gifts”, “we”, “us” or “our”). By accessing or using our website at www.aquaholic.com.sg (“the Website”), or by placing an order with us, you agree to be bound by these Terms and Conditions (“Terms”).
If you do not agree with any part of these Terms, please do not use the Website or submit any orders.
These Terms apply to all visitors, users, and customers. They should be read alongside our Privacy Policy and Disclaimer, which are incorporated by reference.
Permitted Use of This Website
The Website is intended for personal and business use in connection with accessing information about Aquaholic Gifts and its products, and for submitting quote requests and enquiries.
You agree not to use this Website for any of the following:
- Any unlawful, fraudulent or unauthorised purpose
- Transmitting harmful, offensive or disruptive content
- Attempting to gain unauthorised access to our systems or data
- Scraping, crawling or harvesting data from the Website without prior written consent
- Any activity that could damage, disable or impair the Website
Aquaholic Gifts reserves the right to terminate your access to the Website without notice if you violate these Terms or engage in activities deemed detrimental to the Website or its users.
Orders & Custom Products
All orders placed with Aquaholic Gifts are subject to acceptance and availability. As all products are custom-printed to order, the following terms apply:
- Approval required: Production begins only after you have reviewed and approved the digital mockup. Please verify all artwork, colours, text and dimensions carefully before approving.
- Artwork responsibility: You are responsible for ensuring all content, logos and artwork submitted are accurate and that you hold the rights to use them.
- Colour variation: Due to the nature of printing, slight variations in colour between the digital mockup and the final product may occur. These variations are considered acceptable and do not constitute a defect.
- Cancellations: Orders cannot be cancelled or amended once production has commenced.
- Minimum order quantities: MOQ applies per product and will be communicated at the time of quotation.
- Lead times: Standard lead time is 7–14 working days. Express 5-working-day turnaround is available for eligible products at additional cost.
As all products are custom-produced to your specifications, returns and refunds are not accepted unless the product contains a manufacturing defect or a production error attributable to Aquaholic Gifts. Claims must be raised within 7 days of delivery with photographic evidence.
Intellectual Property Rights
All content and materials on this Website — including but not limited to text, graphics, logos, images, videos, product photography and software — are the property of Aquaholic Gifts Pte Ltd and are protected by applicable intellectual property laws in Singapore and internationally.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Website, or its content, without our express prior written consent.
By submitting your company logo or artwork to us for printing, you confirm that you own or have the right to use the intellectual property, and you grant Aquaholic Gifts a limited licence to use it solely for the purpose of fulfilling your order.
Privacy & Personal Data
When using the Website or submitting an enquiry, you may provide personal information including your name, company name, email address and contact number. Aquaholic Gifts will handle this information in accordance with our Privacy Policy and Singapore’s Personal Data Protection Act 2012 (PDPA).
We will not sell or share your personal data with third parties for marketing purposes without your consent.
Limitation of Liability
To the fullest extent permitted by law, Aquaholic Gifts shall not be liable for any indirect, incidental, special or consequential damages arising from:
- Your use of, or inability to use, the Website
- Any errors or omissions in the Website’s content
- Delays, defects or non-conformities in products where the issue arises from customer-supplied artwork errors
- Losses arising from circumstances beyond our reasonable control (force majeure)
Our total liability to you for any claim shall not exceed the value of the order to which the claim relates.
Changes to These Terms
Aquaholic Gifts may update or modify these Terms at any time without prior notice. The most recent version will always be available on this page. It is your responsibility to review these Terms periodically. Continued use of the Website following any changes constitutes acceptance of the revised Terms.
Governing Law & Jurisdiction
These Terms and your use of www.aquaholic.com.sg are governed by the laws of the Republic of Singapore. Any disputes or legal actions arising from these Terms will be subject to the exclusive jurisdiction of the courts of Singapore.
